Therefore, the Occupiers Liability Act ("the Act") was created to ensure that individuals who have suffered from injuries as a result of slip and falls are protected. This Act sets out the responsibilities of an occupier to make sure individuals are always safe when on their premises.

What to do if you Have Been Involved in a Slip and Fall

Preserve Evidence and Take Photos

Following a fall incident, it is important preserve evidence that may prove useful to your case. If you are able, immediately take several photos of the hazard that caused you to fall. If you clothing is wet or damages take a photo of that as well. When you get home, take photos of the top and bottom of the footwear you were wearing. If your fall occurred due to an uneven ledge or hole, return to the scene as soon as possible and take a photo with a measuring tape or ruler that depicts the height and width of the hazard. Report Your Accident Immediately

One of the first ways an insurance company may try to deny your claim is to deny that a fall took place at all. To avoid this it is important to alert a staff member to the fall and request that an incident report be completed. If the fall occurs outside or in an area where it may not be practical to immediately alert someone, make sure that you contact the owner of the area as soon as possible and report what happened. MacIsaac Gow LLP can help you with this and ensure that the proper parties are identified and that the details of the fall are properly recorded.

Further, there are strict timelines that must be adhered to if you have been involved in a fall. As of January 21, 2021, written notice is required for claims pertaining to injuries that were caused by snow and ice. If these injuries were sustained on a municipal sidewalk or walkway, this notice must be provided within 10 days after the injury has occurred. If an action is against a property owner or maintenance contractor, written notice of the claim must be provided within 60 days after the injury has occurred.
